1. Acceptance of Terms

By accessing and using the services of Boelman Media ("we," "our," or "us"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use our services.

2. Services Description

Boelman Media provides professional real estate photography and media services, including but not limited to:

• Professional real estate photography
• Drone aerial photography and videography
• 3D virtual tours and floor plans
• Video production services
• Twilight photography
• Headshot photography
• Content creation and media production

3. Booking and Scheduling

3.1 Aryeo Booking System

We use Aryeo for our booking and scheduling system:

• All bookings must be made through our official booking system
• Booking confirmations will be sent via email
• Rescheduling requires 24-hour notice
• Cancellations must be made at least 48 hours in advance
• Late cancellations may incur a cancellation fee

3.2 Scheduling Requirements

• Property must be photo-ready at scheduled time
• Access to property must be provided as agreed
• Weather conditions may affect outdoor photography
• We reserve the right to reschedule due to inclement weather

4. Payment Terms

4.1 Square Payment Processing

We use Square, Inc. for secure payment processing:

• Payment is required at time of booking or before service delivery
• We accept major credit cards, debit cards, and digital payments
• All payments are processed securely through Square
• Payment information is subject to Square's privacy policy
• Invoices will be provided for all services

4.2 Pricing and Fees

• All prices are listed in US Dollars (USD)
• Prices are subject to change without notice
• Additional fees may apply for rush orders or special requests
• Travel fees may apply for locations outside our service area
• Package upgrades and add-ons are available at additional cost

5. Service Delivery

5.1 Photography Services

• Standard delivery is within 24 hours of photo session
• Rush delivery available for additional fees
• Photos are delivered via secure online gallery
• High-resolution files are provided for MLS and marketing use
• Edits and revisions are included in package pricing

5.2 Quality Standards

• We maintain professional quality standards for all deliverables
• Photos are optimized for real estate marketing
• HDR processing and color correction included
• Final images are MLS-ready and print-quality

6. Client Responsibilities

As a client, you agree to:

• Provide accurate property information and access
• Ensure property is photo-ready at scheduled time
• Communicate any special requirements in advance
• Provide necessary permissions for property photography
• Review and approve deliverables within reasonable timeframe
• Use deliverables in accordance with licensing terms

7. Intellectual Property and Licensing

7.1 Copyright and Ownership

Boelman Media retains copyright to all photographs and media created:

• We grant you a non-exclusive license to use deliverables
• License covers real estate marketing and MLS use
• Commercial use beyond real estate requires additional licensing
• We may use images for portfolio and marketing purposes
• Attribution is appreciated but not required

7.2 Usage Rights

• Deliverables may be used for property listings and marketing
• Sharing with real estate agents and brokers is permitted
• Social media use is allowed with proper attribution
• Resale or redistribution of images is prohibited

8. Cancellation and Refund Policy

8.1 Cancellation Terms

• 48+ hours notice: Full refund or reschedule
• 24-48 hours notice: 50% refund or reschedule
• Less than 24 hours: No refund, reschedule subject to availability
• Weather-related cancellations: Full reschedule at no cost

8.2 Refund Process

• Refunds are processed through Square within 5-7 business days
• Processing fees may be deducted from refunds
• Refunds are issued to original payment method

9. Limitation of Liability

Boelman Media's liability is limited to:

• Direct damages up to the amount paid for services
• We are not liable for indirect, incidental, or consequential damages
• We are not responsible for delays due to circumstances beyond our control
• Property damage claims must be reported within 24 hours

10. Indemnification

You agree to indemnify and hold harmless Boelman Media from any claims, damages, or expenses arising from:

• Your use of our services
• Violation of these terms
• Infringement of third-party rights
• Property access or safety issues

11. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy for details on how we collect, use, and protect your information. By using our services, you consent to our data practices as described in our Privacy Policy.

12. Third-Party Services

Our services may integrate with third-party platforms:

• Square: Payment processing and invoicing
• Aryeo: Booking, scheduling, and client management
• Google Services: Analytics and business tools

These services have their own terms and privacy policies.

13. Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control, including but not limited to:

• Natural disasters and severe weather
• Government actions or restrictions
• Equipment failures or technical issues
• Unforeseen emergencies or accidents

14. Modifications to Terms

We reserve the right to modify these terms at any time:

• Changes will be posted on our website
• Continued use constitutes acceptance of modified terms
• Material changes will be communicated via email
• Previous terms apply to existing bookings

15. Governing Law and Disputes

These terms are governed by the laws of the State of Iowa, United States. Any disputes will be resolved through:

• Good faith negotiation between parties
• Mediation if direct negotiation fails
• Legal action in Iowa courts as a last resort
